Unibet Fined AU$1 Million for Breaching Australian Gambling Laws
Unibet, a popular online casino and gambling platform, has recently been fined AU$1 million for over 100,000 violations of the Interactive Gambling Act 2001 in Australia. The Australian Communications and Media Authority (ACMA) conducted an investigation and found that Unibet failed to close the accounts of 954 customers who had registered with BetStop, Australia’s National Self-Exclusion Register (NSER).
Failure to Close Accounts
Unibet paid a total penalty of AU$1,014,120 for not taking appropriate actions to close the accounts of customers who had signed up with BetStop. BetStop is a government-backed initiative that allows Australians to block themselves from all licensed online casinos and mobile betting apps. Once registered with BetStop, individuals are prohibited from placing bets, opening new accounts, or receiving marketing messages from online casinos.
Despite the self-exclusion period, 45 customer accounts remained open for 190 days or more. While these accounts were inactive for betting during the self-exclusion period, they were able to resume full activity once the period ended. One player even placed over 1,200 wagers after their self-exclusion period expired, which is a serious violation of the Interactive Gambling Act.
ACMA Investigation
Carolyn Lidgerwood, the ACMA’s Gambling Lead, expressed serious concerns about Unibet’s actions, stating that the company took too long to close accounts and failed to support customers seeking help with their gambling habits. The NSER rules are designed to ensure that individuals make a conscious decision to resume gambling after a self-exclusion period, and accessing old accounts undermines this process.
Penalties and Undertakings
In addition to the monetary penalty, Unibet has agreed to a two-year court-enforceable undertaking with the ACMA. The company will undergo an independent review of its internal compliance systems and implement all recommended improvements. Unibet has also committed to refunding the customers affected by these breaches of the law.
Second Penalty for Unibet in Australian Market
This is not the first time Unibet has faced penalties in the Australian market. In 2021, the company entered the market by acquiring Betchoice, an online bookmaker based in the Northern Territory. In May 2023, Unibet was fined AU$60,000 for breaching state gambling laws by offering ‘inducements’ to gamble through its promotional activities.
An investigation revealed that Unibet had been promoting ‘price push’ offers, which are considered illegal under Australian law. Betchoice pleaded guilty to two offenses, paying AU$30,000 for each, and covering the costs of the investigation.
